1. About these terms
These terms govern your use of databit.ca, the marketing site of Databit Solutions (“Databit”, “we”, “us”), operated by Stijn Servaes from Canada. Use of the site means you accept these terms. If you do not, please do not use the site.
These terms govern the marketing site only. Paid client engagements are governed by a separate written engagement contract (statement of work, master services agreement, or both). Where those documents conflict with these terms in the context of a paid engagement, the engagement contract controls.
2. The service
The site is informational. It describes Databit’s services, published work, and views, and offers a contact form, a booking link, and editorial content. The site is not a paid product and does not require an account.
3. Acceptable use
When using the site, you agree not to:
- Submit false, misleading, or unlawful content;
- Attempt to access the site or any underlying system in a way it was not intended (e.g. exploit-style probing, credential stuffing);
- Scrape content at a rate that interferes with normal operation;
- Use the contact form or booking link for spam, harassment, or bulk solicitation;
- Use any portion of the site in violation of applicable export control or sanctions law.
We may rate-limit, restrict, or block access where any of the above is suspected, and we reserve the right to refuse service to anyone for any lawful reason.
4. Intellectual property
The site, including text, layout, brand marks, illustrations, code samples, and editorial content, is the property of Databit Solutions or its licensors, and is protected by Canadian and international intellectual property law. You may quote short excerpts of editorial content for non-commercial purposes with attribution. You may not reproduce, redistribute, or use the site or its contents to train machine-learning models for commercial gain without prior written permission.
Client logos, names, and case-study materials shown on the site are used with the relevant client’s permission and remain the property of those clients.
5. Editorial content disclaimer
Editorial content (insights posts, how-we-work descriptions, opinion pieces) reflects the author’s views at the time of writing and is provided for general information. It is not legal, financial, medical, or professional advice. You should not act or refrain from acting on the basis of editorial content without first engaging us under a written contract or consulting an appropriately qualified advisor.
6. No warranty
The site is provided “as is” and “as available” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not guarantee that the site will be uninterrupted, error-free, or free of malicious content. Use at your own discretion.
7. Limitation of liability
To the fullest extent permitted by law, Databit Solutions and Stijn Servaes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site, whether based on contract, tort, statute, or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of the site (excluding paid engagements, which are governed by their own contract) is limited to one hundred Canadian dollars (CAD $100).
8. Indemnification
You agree to indemnify and hold Databit Solutions and Stijn Servaes harmless from any claim, damage, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these terms or your unlawful use of the site.
9. Governing law and jurisdiction
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles. The courts of Ontario have exclusive jurisdiction over any dispute arising from these terms or your use of the site, except that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
10. Changes to these terms
We may update these terms as the site evolves or as the law requires. Material changes will be reflected by updating the “last updated” date above. Continued use of the site after changes take effect means you accept the updated terms.
